1. Scope of application
These Terms and Conditions apply to the services contracted by users and companies through the website https://www.mindcoachers.com/ (hereinafter, the “Website”), owned by MindCoachers. In case of conflict between the specific terms and conditions of a programme, course or training activity (hereinafter referred to as “course”) and these Terms and Conditions, the specific terms and conditions shall prevail.
2. Recruitment Modalities
2.1. Contracting by Users or Companies
The courses offered by MindCoachers can be booked to be conducted face-to-face or online via the web.
- User Booking: Users can book their place on a course via the Web by providing the information required under our Privacy Policy. If you are receiving treatment at another centre or with other professionals, you must obtain their consent prior to enrolling in the course. MindCoachers may request proof of such consent. Refusal to provide it may prevent your enrolment and participation in the course.
- Recruitment by companies: Companies interested in reserving places on the courses can do so through the website, indicating the number of people for whom they wish to reserve a place. It is not necessary for companies to provide personal information about the people who will take the course.
2.2. Face-to-face and Online Modalities
Depending on the offer available on the web, courses can be taken in the following modalities:
- Face-to-face modality: It will take place at the place and time indicated by MindCoachers. Travel and accommodation expenses are not included in the price unless otherwise indicated. Failure to attend the contracted activity on the specified date and time does not entitle the user to attend another course on another date, unless otherwise agreed with MindCoachers.
- Online mode: Some courses can be contracted to be taken entirely online. By enrolling in an online mode, you acquire a licence to use the contents through the Web, in accordance with the conditions of the contracted course and the intellectual property clause of these Terms and Conditions.
2.3. Self-learning materials
The Website offers licences for the use of self-learning materials, such as audios, books and other digital content. Unless otherwise indicated, these licences are granted indefinitely for non-commercial use, with no right of modification, public communication, redistribution or exploitation.
3. Price and Method of Payment
The price of the course or training activity will be specified before contracting and will include VAT and other applicable taxes. Payment can be made through the website by credit card or PayPal.
4. Invoicing
A PDF invoice will be issued for registrations made through the website. To receive it, explicit consent is required by clicking on “I agree to receive an invoice (free of charge)” when placing the order. A paper or digital invoice can also be requested by emailing info@mindcoachers.com. Your personal data will be processed in accordance with our Data Protection Policy.
5. Right of withdrawal
The user has the right to cancel the subscription without justification within fourteen calendar days of purchase. To do so, it is recommended to send an email to info@mindcoachers.com with the necessary information.
5.1. Exceptions to the Right of Withdrawal
- Online Programmes and Self-Learning Materials: The right of withdrawal is lost once access to the digital content has begun.
- Audio: The right of withdrawal is lost when accessing the audio download link.
- On-site programmes: The right of withdrawal does not apply to services with a specific date of execution.
6. Cancellation
Cancellation and refund policies are detailed in each course description on the website and in the confirmation email.
7. Guarantee
MindCoachers guarantees the conformity of the digital content and services supplied for a period of two years from delivery. Users may demand the correction of any lack of conformity, reduction of the price or termination of the contract, in accordance with the provisions of the regulations in force.
8. Responsibilities
- Programmes and Training Activities: MindCoachers offers psychoeducational programmes, not medical services. Results in terms of improved health or quality of life are not guaranteed.
- Use of Exercises: Relaxation exercises should be performed at times of rest. They should not be performed during activities that demand attention or pose a risk.
9. Non-compliance
MindCoachers may suspend or terminate the user’s account and subscriptions in the event of any breach of these terms and conditions, including unauthorised copying of content.
10. Intellectual Property
MindCoachers is the owner of all intellectual property rights over the website and its contents. Any form of reproduction, public communication, modification and exploitation requires the written authorisation of MindCoachers.
11. Applicable Law and Competent Court
These conditions are governed by Spanish law. The parties submit to the jurisdiction of the courts of the user’s domicile.
